1. Agreement
These terms are a contract between you (or the company you represent) and Sixty Seven Digital FZCO, licensed in the IFZA free zone, Dubai, United Arab Emirates ("Verifyre", "we"). By creating an account, buying credits, calling the API, installing the widget or plugin, or using the free tools, you accept them. If you act for a company, you confirm you may bind it. Our Privacy Policy and, for business customers, the Data Processing Addendum are part of this agreement.
2. The service
Verifyre verifies email addresses: it checks syntax, DNS and mail server records, reputation lists and, where the receiving server permits, holds an SMTP conversation to ask whether a mailbox exists, then returns a verdict, reason and score. It also offers bulk list processing, integrations with third-party platforms, an API, a JavaScript form widget, a WordPress plugin and free single-purpose tools.
Verification is an inference from the answers of systems we do not control. Mail servers may lie, change, greylist, accept everything or refuse to answer. We report what we observed and label uncertainty honestly, but we do not guarantee that an address marked deliverable will accept a given message, or that one marked undeliverable would have bounced. Your sending decisions are yours.
3. Accounts
You must give accurate details, keep your password and API keys secret, and tell us promptly if you suspect misuse. You are responsible for everything done through your account and keys. One person may not keep several free accounts to multiply free credits. You must be at least 16 and able to enter a contract.
4. Credits and payment
The service is sold as credits. One credit is consumed for each live verification of a unique, well-formed address; duplicates, malformed rows and cached results are free, and the unchecked remainder of a cancelled job is refunded to your balance. Credits are bought in packs at the prices shown on the pricing page, in the currency shown, plus any applicable tax. Credits never expire while your account exists. Credits are not money: they cannot be transferred between accounts, exchanged for cash or refunded, except as set out in section 5.
Payments are processed by Stripe (cards) or by invoice for enterprise agreements. Invoices are due within 30 days unless the order form says otherwise; we may suspend verification on overdue accounts after notice. Prices may change for future purchases; credits already bought keep their value.
The free credits granted on sign-up, in promotions or through the free tools are a gift, may be limited, and may be withdrawn from accounts that abuse them.
5. Refunds
If a pack was bought by mistake and no credits from it have been used, write to us within 14 days and we will refund it. We also refund credits consumed by a verified fault in the service (for example a job that failed through our error). We do not refund credits because verification results differed from your expectations, because a mail server gave an uncertain answer, or because you no longer need them.
6. Acceptable use
Verification touches other people's mail servers, so we are strict. You must not use Verifyre to:
- verify addresses you have no lawful basis to contact, including purchased, scraped or stolen lists;
- validate lists for spam, phishing, fraud, harassment or any message that is unlawful where it is sent or received;
- enumerate or guess mailboxes at a domain you do not control;
- circumvent rate limits, fair-use limits or free-credit limits, including by automation against the free tools or by multiple accounts;
- resell or sublicense the service, or embed it in a competing verification product, without a written agreement;
- probe, scan or attack the service, or interfere with other customers' use of it;
- upload content that infringes rights or contains malware.
You confirm that for every address you verify you are the controller (or act for one) with a lawful basis to process it, and that you will honour any request from a data subject that reaches you.
We may suspend or close accounts that breach this section, refuse abusive traffic at the network level, and report unlawful activity to authorities. Where practical we will warn you first.
7. The API, widget and plugin
API keys and widget keys identify your account; keep them secret and rotate them if exposed. Rate limits apply as documented and may be raised on request. We may change API behaviour with notice and will keep deprecated versions available for a reasonable period. The widget and plugin are licensed to you for use on sites you control; the code is ours and may not be modified to misrepresent its origin.
8. Third-party platforms
Integrations connect to Mailchimp, Klaviyo and other platforms using credentials you supply. Those platforms' terms govern your use of them. We are not responsible for changes they make, for data they hold, or for actions (tags, unsubscribes) taken on your instruction.
9. Your data and our data
You own the lists and results you process; you grant us only the licence needed to run the service for you. We process addresses as your processor under the DPA and delete them when you delete a job. We own the service, its software, engine, lists, documentation and brand. We may use aggregate, de-identified statistics (counts, timings, provider behaviour, never addresses) to improve the service.
10. Availability
We aim for 99.9% monthly availability for the API and dashboard and publish incidents on our status page. Outside an enterprise agreement with an SLA, availability is provided on a best-effort basis and planned maintenance is announced in advance where possible.
11. Warranties and disclaimers
The service is provided "as is" and "as available". To the fullest extent the law allows we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and accuracy of results. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.
12. Limitation of liability
To the extent the law allows, neither party is liable to the other for indirect, consequential, special or punitive loss, or for lost profits, revenue, data or goodwill. Our total liability under this agreement in any 12-month period is limited to the amount you paid us in that period, or USD 100 if you paid nothing. These limits apply however the claim arises.
13. Indemnity
You will defend and indemnify us against claims arising from your lists, your messages, your breach of section 6 or your breach of applicable law, including data protection and anti-spam laws.
14. Suspension and termination
You may close your account at any time from the dashboard; unused paid credits are forfeited unless section 5 applies. We may suspend or terminate for breach of these terms, non-payment, legal requirement or abuse, with notice where practical. On termination we delete your jobs and results within 30 days and keep only what section 8 of the Privacy Policy requires.
15. Changes to the service and these terms
We may change the service, and these terms, from time to time. For material changes to the terms we will give account holders at least 14 days' notice by email or in the dashboard; continued use after that date is acceptance. If you do not accept a change, close your account before it takes effect and we will refund unused credits from packs bought in the preceding 60 days.
16. Governing law and disputes
These terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates as applied in the IFZA free zone. The courts of Dubai have exclusive jurisdiction, except that either party may seek injunctive relief anywhere, and consumers in the EEA or UK keep any non-excludable protections of their home law. Before suing, each party agrees to raise the dispute in writing and try in good faith to resolve it within 30 days.
17. General
These terms are the whole agreement and replace earlier ones. If a clause is unenforceable the rest stands. Neither party is liable for delay caused by events outside its reasonable control. You may not assign this agreement without our consent; we may assign it to a successor of the business. Notices to us go to legal@verifyre.co; notices to you go to your account email.
